Terms of Service

1. Agreement to Terms
By accessing or using the Persian.Kids application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
The Service is operated by Hubizens LLC, a limited liability company registered in the State of Delaware, United States. In these Terms, "we", "us", and "our" refer to Hubizens LLC. Persian.Kids is one of its products. Ali Jazayeri is the founder of both Hubizens and Persian.Kids, which is why his name may appear as the developer or provider in app store listings and other app information.
Persian.Kids is an educational platform designed for children of Iranian diaspora families. The Service is intended to be used by children under the supervision and consent of a parent or legal guardian. By creating an account, you represent that you are at least 18 years old and, if you create a child profile, that you are the parent or legal guardian of that child.
Hubizens is a small, independent team with no legal, financial, operational, or organizational affiliation with any government, governmental body, or other institution.
2. Description of Service
Persian.Kids provides:
- Interactive educational lessons for learning Persian language (reading, writing, and comprehension).
- Exercises and games based on the Iranian national educational curriculum.
- Cultural, historical, and geographical content about Iran.
- Progress tracking, achievements, badges, and gamification features to motivate learning.
- Parent dashboard for monitoring children's learning progress.
- Assignment and grading request features.
- A directory of independent Persian-language teachers that parents can browse and contact.
- One-to-one text messaging between adult account holders and approved teachers.
- Class requests, scheduling, and live online classes delivered by video.
- Ratings and reviews of teachers by parents who attended their classes.
The teacher directory, messaging, class requests, live classes, and reviews are adults-only features. They are not available from a child profile. See Sections 7, 8, and 9.
The Service is provided on an "as is" and "as available" basis. We continuously work to improve and expand our educational content.
3. Account Registration
3.1 Parent Accounts
- Only adults aged 18 or older may create accounts.
- You must provide a valid email address for account creation and communication.
- You are responsible for maintaining the confidentiality of your password.
- You are responsible for all activity that occurs under your account.
- Display names do not need to be real names — you may use any name or nickname.
3.2 Child Profiles
- Only the parent account holder may create child profiles.
- Child profile names can be nicknames or made-up names — real names are not required.
- The parent is responsible for the appropriate use of the Service by their children.
- Children cannot create accounts independently, and cannot message, contact, or be contacted by any other user.
3.3 Teacher Accounts
- You must be at least 18 years old to apply for a teacher account.
- Because a teacher profile is shown publicly, you must use your real, professional name and provide accurate information about yourself, your experience, and the subjects you teach.
- You are solely responsible for the accuracy of every claim in your profile, including any qualifications, credentials, or experience you describe.
- You may only upload a profile photo that you have the right to use, and it must show you.
- A teacher profile is not visible in the directory until we approve it. Approval is at our sole discretion, and we may reject, suspend, or remove a profile at any time, with or without reason.
- You may not create a teacher account on behalf of someone else, or share your teacher account with another person.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use the Service to transmit any harmful, threatening, abusive, or objectionable content.
- Use automated means (bots, scrapers, etc.) to access the Service without our prior written consent.
- Share your account credentials with unauthorized individuals.
- Reproduce, distribute, or create derivative works based on the educational content without our permission.
In addition, when using the messaging, class request, or live class features you agree not to:
- Harass, threaten, defame, or discriminate against another user.
- Attempt to communicate directly with a child, or ask a parent to hand contact with a child over to you outside the parent's supervision.
- Solicit a child's personal contact information, photographs, or social media accounts.
- Send unsolicited commercial messages, spam, or promotions for unrelated products or services.
- Share another person's personal information without their consent.
- Use contact details obtained through the Service for any purpose other than arranging or delivering the classes in question.
- Record, screenshot, or redistribute a live class or any part of it without the consent of everyone present.
Violating these rules may result in a warning, suspension, or permanent removal of your account, at our discretion.
5. Educational Content
5.1 Content Ownership
All educational content on Persian.Kids — including but not limited to lessons, exercises, illustrations, audio recordings, animations, and curriculum materials — is owned by Hubizens LLC or used under license. This content is protected by copyright and other intellectual property laws.
5.2 Curriculum Basis
Our educational content is based on the Iranian national educational program. While we strive for accuracy and educational quality, Persian.Kids is an independent educational platform and is not officially affiliated with or endorsed by the Iranian Ministry of Education or any government body.
5.3 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the educational content within the Service for personal, non-commercial educational purposes only. This license does not include the right to reproduce, distribute, modify, or publicly display any content outside of the Service.
5.4 Content You Provide
You retain ownership of the content you submit — your profile text, photo, messages, class descriptions, and reviews. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and distribute that content within the Service for the purpose of operating it. You represent that you have the right to submit the content and that it does not infringe anyone else's rights. Any teaching materials a teacher creates and uses in their own classes remain entirely theirs.
6. Subscription and Payment
- Certain features of Persian.Kids require a paid subscription.
- Subscription fees, billing cycles, and available plans are displayed within the Service.
- On iOS, subscriptions are purchased through the Apple App Store and are billed to your Apple ID. They renew automatically unless cancelled at least 24 hours before the end of the current period, and can be managed or cancelled in your Apple ID account settings. Apple's terms govern that transaction.
- On the web and on Android, payments are processed securely through Stripe. We do not store your credit card or payment details.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We reserve the right to change subscription pricing with reasonable notice. Existing subscribers will be notified before any price change affects their renewal.
- Refund requests for purchases made through the App Store are handled by Apple under Apple's refund policy. For other purchases, contact us at the email address below and we will handle the request on a case-by-case basis.
7. Teachers, Classes, and Payments
Persian.Kids helps parents find independent teachers. It is a place to discover and contact a teacher — it is not a school, an employment agency, or a party to whatever you agree with a teacher.
7.1 Teachers Are Independent
Teachers listed on Persian.Kids are independent individuals. They are not employees, agents, contractors, partners, or representatives of Hubizens LLC or Persian.Kids. We do not direct, supervise, or control how, when, or what a teacher teaches, and no employment, agency, joint venture, or partnership relationship is created between us and any teacher.
7.2 What Approval Means — and Does Not Mean
Before a teacher profile appears in the directory, our team reviews it. That review is a check of the profile as submitted — it is not a background check, a criminal record check, an identity verification, a reference check, or a verification of any qualification, degree, certificate, or claim of experience. Approval is not an endorsement, recommendation, or guarantee of a teacher's suitability, competence, safety, or conduct.
Parents are solely responsible for evaluating any teacher before engaging them, for deciding whether that teacher is appropriate for their child, and for supervising their child during any class or interaction with a teacher. We strongly recommend that a parent be present for any class involving their child.
7.3 Fees and Payments Are Between You and the Teacher
- Any fee shown on a teacher's profile is set and published by that teacher. It is displayed for your information only.
- We do not charge, collect, process, hold, or refund any payment between a parent and a teacher. Persian.Kids has no payment feature for classes.
- All financial arrangements — the amount, the method, the timing, cancellations, and refunds — are agreed and settled directly between the parent and the teacher, outside of Persian.Kids. Your Persian.Kids subscription is separate and unrelated to any fee a teacher charges.
- We are not a party to that arrangement, we take no commission from it, and we have no responsibility or liability for it.
7.4 Classes and Disputes
- Class content, quality, scheduling, punctuality, cancellations, and no-shows are the responsibility of the teacher and the parent involved. We do not guarantee that a scheduled class will take place.
- Any dispute arising from a class or a payment is between the parent and the teacher. We may, at our discretion, look into a report and take action on an account, but we are under no obligation to mediate, arbitrate, or resolve a dispute, and we are not responsible for its outcome.
- Any arrangement to meet in person, or to communicate outside Persian.Kids, is made entirely at the parties' own risk and outside the scope of these Terms and of anything we can see or control.
- If a teacher or a parent behaves inappropriately, report them through the app or at the email address below. We take reports of conduct involving children extremely seriously.
8. Messaging and Reviews
- Messaging is available only between an adult account holder and an approved teacher. There is no messaging between children, between a child and a teacher, or between a child and any other user.
- Messages are plain text only — no attachments, photos, or voice messages.
- Either side may mute notifications from a conversation, and either side may block the other. A teacher may turn off in-app messages entirely.
- Messages are stored on our servers and are not end-to-end encrypted. We do not routinely read them, but our admin team may review the content of a conversation when investigating a report or when required by law.
- You may only review a teacher whose class you actually attended, and a review must be your genuine experience. Reviews that are false, abusive, defamatory, or written to manipulate a rating may be hidden or removed.
- Teachers may leave a private rating of a parent. It is never displayed publicly.
9. Child Safety
We are committed to providing a safe environment for children:
- Children cannot message or communicate with anyone in the app. There is no child-to-child, child-to-teacher, or child-to-stranger communication of any kind.
- The teacher directory, messaging, class requests, live classes, and reviews are adults-only features. They live inside the parent's or teacher's own account and cannot be reached from a child profile.
- A child profile is never listed, searchable, or visible to a teacher or any other user.
- Teachers never receive a child's profile, learning progress, scores, or activity.
- There is no user-generated content from children that is publicly visible.
- Children's profiles are accessible only to the parent who created them.
- All educational content is curated and reviewed for age-appropriateness.
- We do not collect personal information directly from children.
- Live classes are never recorded. Class rooms are created with recording disabled.
- The Service does not access device location, contacts, or the camera and microphone outside of a live class that an adult chooses to join.
10. Privacy
Your privacy is important to us. Our use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to our Privacy Policy.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
While we strive to provide high-quality educational content, we do not guarantee that:
- The Service will be uninterrupted, error-free, or completely secure.
- The educational content will meet every individual learning need.
- Learning outcomes or academic results will be achieved through use of the Service.
- Any teacher listed in the directory is qualified, suitable, available, or will perform as described.
- Any information in a teacher profile, message, or review is accurate.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUBIZENS LLC AND ITS MEMBERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
WITHOUT LIMITING THE ABOVE, WE ARE NOT LIABLE FOR THE CONDUCT OF ANY TEACHER, PARENT, OR OTHER USER, FOR THE CONTENT OR QUALITY OF ANY CLASS, FOR ANY PAYMENT OR AGREEMENT MADE BETWEEN A PARENT AND A TEACHER OUTSIDE THE SERVICE, OR FOR ANY INTERACTION THAT TAKES PLACE OFF THE PLATFORM OR IN PERSON.
Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
13. Account Termination
- You may delete your account at any time from within the app, or by contacting us.
- We reserve the right to suspend or terminate accounts that violate these Terms.
- Upon account deletion, all associated data (including child profiles and learning progress) will be permanently removed within 30 days, as described in our Privacy Policy.
14. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or through a notice in the application. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration. Nothing in this section limits any rights you may have under the mandatory consumer protection laws of the country in which you live.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.
